Una de esas actividades sería la docencia universitaria y, más concretamente, la evaluación docente universitaria. Este contratiempo afectaría al desarrollo de la enseñanza en las universidades, materia que la Constitución califica en su artículo 27 como derecho fundamental.

Sin embargo, los derechos fundamentales están sujetos a límites o condicionamientos igualmente presentes en el ordenamiento jurídico. El derecho a la educación debe compaginarse con el derecho a la vida y a la integridad física que reconoce el artículo 15 de la norma constitucional, complementado a su vez por el artículo 43 de esta norma que prevé el derecho a la protección de la salud.

Este último precepto actúa como un mandato de acción para los poderes públicos que requiere la necesaria colaboración de la ciudadanía. El sector público está obligado a velar por la salud de ciudadanos y ciudadanas y de su personal público.

De igual modo, el sector privado deberá observar las normas sanitarias en beneficio de consumidores y usuarios, así como de sus trabajadores y trabajadoras. La declaración del estado de alarma y su desarrollo ha supuesto el cierre de los centros universitarios tanto públicos como privados.

Esta circunstancia impide legal y fácticamente el seguimiento de clases presenciales. Tampoco pueden realizarse exámenes in situ. La situación exige soluciones que permitan la impartición de clases y la realización de exámenes en modo no presencial a fin de cumplir la ley, preservar la salud pública y garantizar la continuidad de la docencia universitaria.

La única solución viable consiste en clases y pruebas on line. No obstante, el traslado de la docencia y la evaluación docente al entorno virtual requiere hacerlo con la mayor fidelidad posible para no alterar la esencia de la enseñanza universitaria presencial.

De hecho, las universidades on line recurren normal y sistemáticamente a pruebas presenciales. Sin embargo, en el actual contexto de pandemia sanitaria no se prevén con carácter general pruebas presenciales.

Por ello, la realización remota y virtual de exámenes debe efectuarse siguiendo unas consignas análogas a las establecidas para pruebas presenciales. Estas consignas serían la realización de pruebas en un mismo espacio de tiempo para todo el alumnado a evaluar, bajo supervisión docente e impidiéndose prácticas de plagio u otras irregularidades.

Las consignas aludidas son de evidente garantía en un contexto presencial pero su aseguramiento en el ámbito virtual requiere articular ciertas reglas.

Las reglas consistirían en conectarse remotamente durante el mismo período y activar la webcam y el micrófono. En función de las condiciones concretas de la prueba, podría exigirse también la grabación de su realización por parte del alumnado o, incluso, habilitar acceso a los propios dispositivos de cada estudiante.

Ilustración: David Lecumberri Irisarri. En un entorno presencial, el profesorado puede supervisar la prueba de manera inmediata verificando que cada participante está haciendo el examen y no está empleando recursos de información no admitidos.

No obstante, esa labor de supervisión y su efectividad deja de ser evidente o automática en un entorno virtual. Por ello, su operatividad debe garantizarse a través de las reglas antes mencionadas. La imposición de estas reglas conlleva el tratamiento de datos personales de los estudiantes participantes en las pruebas universitarias.

Estos datos son principalmente la voz, imagen y conocimientos académicos del alumno, así como, en su caso, el tipo de dispositivo y conexión empleados para realizar la prueba. Su tratamiento consistirá en el acceso o la visualización y, ocasionalmente, su registro o grabación.

Además de las condiciones de tratamiento de los datos en cuestión, debe analizarse que base jurídica legitimaría dicho tratamiento. Primeramente, debe descartarse el consentimiento de cada estudiante como posible base legitimadora. El consentimiento es sólo una de las diversas bases previstas para el tratamiento de datos por el artículo 6 Reglamento General de Protección de Datos de la Unión Europea.

No cumpliéndose tales premisas, imponer un consentimiento no voluntario resultaría una acción nula de plena derecho. Procede desterrar falsos mitos en torno a la protección de datos. Ni esta normativa impide el tratamiento justificado de datos ni este tratamiento debe basarse necesariamente en el consentimiento de las personas interesadas.

Descartado el consentimiento, procede preguntarse qué base legitimaría el tratamiento de datos descrito. Como se manifiesta en el ámbito de la Conferencia de Rectores de Universidades Españolas CRUE y se prevé por la Agencia Española de Protección de Datos AEPD , la base legitimadora sería el interés público.

Asimismo, ese interés público se fundamentaría en la legislación universitaria. Concretamente el artículo Todo tratamiento de datos no basado en el consentimiento tendría pues un carácter obligatorio interés público, obligación legal, salud pública u otros , sin perjuicio de matices en relación con tratamientos basados en bases contractuales contrato laboral, prestación de servicios u otro contrato en el que exista concurso de voluntades.

El hecho de que la evaluación universitaria on line requiera un tratamiento de datos de carácter obligatorio, basado en un interés público justificado legalmente, no exime a la Universidad del respeto de los derechos preexistentes del alumnado afectado por dicho tratamiento.

Cada estudiante debe poder acceder a información suficiente sobre las condiciones del referido tratamiento de datos y disponer de la facultad de ejercer derechos de acceso, rectificación, portabilidad y otros en materia de protección de datos.

Asimismo, la Universidad debe aplicar este tratamiento según el principio de minimización, esto es, conforme a criterios de necesidad y proporcionalidad. The data from KKNK and GNAF were combined and factor analyses were applied to determine the role and attributes of entrepreneurs. Cross-tabulation analyses were used to illustrate the comparison of language with socio-demographical variables marital status, qualification, province, family business, personal attributes, business premises and resourcefulness and the role and attributes of entrepreneurs.

In addition, the association of language with independent variables was examined by means of one-way ANOVA for the three language groups. Wastewater analysis is a powerful method that can provide useful information about the abuse of legal and illicit drugs. The aim of our study was to determine nicotine consumption during four different music festivals and to find a connection between smoking and preferences for specific music styles using wastewater analysis.

The amount of the nicotine metabolite cotinine was monitored in wastewater at the influent of three waste water treatment plants WWTPs in the Czech Republic and Slovakia, where the festivals took place.

Urinary bio-markers of nicotine utilization were analyzed by LC-HRMS. More than 80, festival participants were monitored during our study from June to September A significant increase of nicotine consumption was observed in wastewaters during music festivals.

The Arts Festivals were Innibos, Oppikoppi and Volksblad. Problem investigated: The literature review clearly shows that, in order for marketers of festivals to use scarce resources effectively and efficiently, it is paramount to do market segmentation.

The advantages of market segmentation lie in an increase in visitor numbers, better image, and by creating a competitive advantage to name but a few.

Method of research: The research was conducted by means of structured questionnaires at the three arts festivals. The data was used to compile a profile of each Festival.

The significance of the correlation between the three Festivals and their profiles were tested by using effect sizes and Chi-square. A sample size of questionnaires for Volksblad, questionnaires for Innibos and for Oppikoppi was used. Findings: The results show that the visitor profile variables that are significant for market segmentation purposes include:language; the province in which Festival attendees reside; days spent at the Festival ; and the size of the travelling group.

These results confirmed but also contradicted a number of similar studies conducted. The results also clearly showed the different profiles of each of the three arts festivals.

The number, range, and diversity of events with a character of festivals have been growing in the Lublin Region over the last several years.

The events are organised by various entities and institutions. Information about them is largely dispersed. No study has been conducted so far determining the spatial distribution of festivals at the regional scale, and analysing their offer in the context of possibilities of development of festival tourism.

Therefore, a study in the scope was undertaken with consideration of the cultural conditionings of some of the events.

Material and methods. In periods from July to December and from September to December , secondary information was analysed statistics, records, and scientific studies, and original material was collected field inventory, interview, and diagnostic survey regarding the current condition of festival tourism in the Lublin Region.

The collected data on festival tourism offers suggest that the number of festivals in the Lublin Region has been continuously increasing from year to year.

According to the obtained data, festivals with a duration of 3 and 5 days are dominant. The majority of festivals are held in summer months, usually on weekends. Music and interdisciplinary festivals with international, national, and regional range are prevalent.

Some of them already have a history of 47 years. The analysis of the spatial distribution of the festivals subject to the inventory suggests that the majority of them are organised in the largest cities of the region, namely Lublin, Zamośæ, and Kazimierz Dolny.

Due to the very diverse offer of festivals , and the manner of their promotion, they play an important role in the promotion of the Lublin Region.
